What is Probate?
Probate is the legal process of administering a person’s estate after they have died. If there is a valid Will, the executors named in the Will will usually apply for a Grant of Probate, giving them the legal authority to deal with the deceased’s estate.
If there is no valid Will, the estate is usually administered through Letters of Administration, and the person appointed by the court becomes the administrator.
Once the appropriate legal authority has been obtained, the estate can be collected, debts and taxes paid, and the remaining assets distributed to the beneficiaries.
